The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “Customer”, “You” and “Your” refers to you, the person accessing or using this website and its services and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company (CulServers/culservers.com). “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Transfers

Ideally we prefer the client downloads from their website files and database from the previous server, zip the files and upload to our website to send by email. In cases where the client is having trouble getting files/database from the previous server, we are happy to help as a courtesy service. Keep in mind we will not be held responsible for any form of data loss or damage, thus the transfer service is offered at your own risk.

Prohibited Content

All products/services we provide must not be used in violating any relevant law, regulation, ordinance, or court order. The client agrees to indemnify and hold harmless culservers.com from any claims resulting from the use of our product/services.
Prohibited content includes but not limited to:

• Contents or code that facilitate any violation our terms of service.
• Contents or code that describe ways to violate our terms of service.
• Stollen or harvested address or information.
• Phishing websites or websites used to send out mass phishing or malicious emails.
• High-yield investment programs.
• Websites that send email spam in order to advertise a website.
• Link farms.

Resource Usage

Bandwidth

There are no hard caps on bandwidth usage but there are soft caps. This means even though we provide an amount of bandwidth for free, usage overage is absolutely possible. We will not suspend an account for bandwidth consumption without an email notice when you have reached 75 percent. Once you have gone beyond the the soft cap, we will inform you by email to make payment within 2 days. The soft cap is determined by the hosting plan and it so high its actually never reached by most of our clients.

Storage Disk Usage

The disk limit is determined by the hosting plan.  Our storage disk is to be used for website’s code or useful files. Our disk must not be used for online storage, backups, archiving of electronic files or documents, log files etc. Prohibited use of the Service will result in the termination of clients’s account, with or without notice and without a refund.

CPU Resources Usage

There are no limits to CPU/processor usage.

Culservers reserves the right to suspend or shut down any web hosting account deemed to adversely affect server performance or network integrity. We will be the sole arbiter of what is considered excessive use/amount of server resources.

Zero Tolerance Spam

Never send unsolicited e-mail, bulk emailing, and spam. “Safe lists” and “double opt-in” will be treated as spam. Any client who sends out spam will have their account terminated with or without notice.

Email agreement

By signing up for our product/services you agree that we can send you email notifications to your account’s primary email address and other email addresses you provide for communicating with you. Our notifications may contain important information regarding service related updates and some information related to your account.

Backups

Culservers will make all effort at its best in protecting and backing up the data of its client. As a client of Culservers, it is your responsibility to each week request weekly backups sent to your. If you are on one of the private plans, you are responsible for creating your backups. We will not be held responsible for any loss or damage of data.

Affiliate Commissions

You can not earn commission on the purchase of your own web hosting account and/or purchases made on your own billing account. You cannot refer yourself. Commissions are one time i.e. on the first purchase of the client. Minimum withdraw amount is $1. You cannot have multiple accounts.

Deals

All deals/promos are one time offer only i.e. on the the first purchase of the client. If you request a refund on a promo/deal plan, the deal will be forfeited and you will be charged at the standard price for the number of free months used. Our free domain deal offers only .com domains.

Suspension

We reserve the right to suspend or terminate a clients account or service with or without notice for reasons including but not limited to violation of our terms of service.

Copyright 

Our product/services should only be used for lawful purposes. We will cooperate with law enforcement agencies regarding alleged copyright infringement. Unlawful acts include but not limited to, material protected by copyright, trademark, trade secret or other intellectual property rights, creating, utilizing, or distributing unauthorized copies of software.

• We provide a fully managed hosting services so you have more time and focus on your business, we will not be held responsible for the success or failure of your business.
